Agreement:
This Agreement contains the complete terms and conditions that apply to an individual's or company's or entity's publication of material on Webstarter servers. As used in this Agreement, "we" means Webstarter and "you" mean the applicant. "Site" means a World Wide Web site and refers to Webstarter's site located at the URL www.webstarter.co.uk

We may reject your application if we determine (at our sole discretion) that your site is unsuitable for publication on our servers. Unsuitable sites include those that:
Promote sexually explicit materials
Promote violence
Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
Promote illegal activities
Include "Webstarter" or variations or misspellings thereof in their domain names for the purpose of any of the above.

We reserve the right to reject your application. If we accept your application and your site is thereafter determined (at our sole discretion) to be unsuitable for Webstarter, whereupon we would cease publication of your website on our servers.

Webstarter reserves the right to update the boundaries of unsuitable sites.

Term of the Agreement (clients)
The term of this Agreement will begin upon our acceptance of your application as a Webstarter client and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. Upon the termination of this Agreement for any reason, you will immediately cease use of, and remove from your site, all links to our site, and all Webstarter trademarks, trade dress and logos, and all other materials provided by or on behalf of us to you pursuant hereto or in connection with Webstarter. Webstarter editor sites is the property of Webstarter. The editor, meaning the templated designs that allow users to edit the content of their website on line via the application in the users admin area and all software and hardware pertaining to a Webstarter site remains the property of Webstarter. Upon registration your payment is non refundable. It is at the discretion of Webstarter if refund conditions apply. The content of the website, content meaning information that the client has placed on the pages of the website remain the property of the client and a copy of such should be kept by the client at all times.

Term of the Agreement (E-commerce)
Webstarter will provide you with the facility to take payments via your Internet payment option, either via PayPal or other for information gathering relating to your shopping cart solution with us.This does not guarantee against fraud to you or fraud by you to your clients. Webstarter, nor any of it's related companies, is in any way held responsible for any disputes payment related or otherwise that your company might have with your clients at any time. Webstarter, nor any of it's related companies, takes any responsibility for fraudulent encounters you experience from visitors to your website further Webstarter takes no responsibility for your payment terms nor for non payment of goods you deliver to your clients, nor any disputes they have with you relating to your website regarding payment or any other matter. You (the Webstarter client) take full responsibility for your payment transactions on your website completely and in ordering our shopping cart ready-made sites you are in agreement with our terms and conditions.

The workings of a Webstarter editor site rely entirely on the templated designs, colours, Webstarter editor e-commerce application and all software and hardware pertaining to Webstarter being on the Webstarter server in order to supply our clients with the advertised service of online editor. Should you remove your site to another the editor is not transferable and remains the property of Webstarter.

Email notification
By giving us your name and email address when you test our webpage builder, you give us permission to contact you with information about Webstarter and it's sister companies Learn Easy, LE Internet Solutions and Super-Arcade products and services.

REFUND POLICY
You can cancel your site at any time However please be sure to make your cancellation BEFORE your payment is due for the month you cancel. If you make your cancellation later your payment will be taken. For example: if your payment falls due on the 25 of July and you cancel your site on the 26th of July the payment for July will be applied. There are NO REFUNDS.

Information Backup
Webstarter is not held responsible for the loss of information on your website. Should you decide to discontinue the use of our Ready-Made websites it is your responsibility to ensure that you have reasonable and up to date backup of your site's content.
You (the client) take ownership of keeping a backup copy of the data, data being text, images, video, and any other file format, you place on your webpages with us (Webstarter)

Webstarter Order Processing:
We will process orders placed by customers over a secure server via PayPal or via or Barclays PDQ machine, or by cheque. Payment for your website will be taken monthly, 6 monthly or annually. This process shall continue until Webstarter is informed, in writing by the owner of the website from Webstarter, that this service is no longer required. The letter requesting termination on our Webstarter servers must include the individual or company's username, password, URL.

Collected Information:
Your personal information is collected when you test a Webstarter guest site. This website currently has no applications or programs that gather information from your computer without your consent. Users are required to give us contact information (e.g., your name and email address) and demographic information (e.g., your zip/post code). Certain information, such as your email address, is collected in order to verify your identity and for use in our records. Information collected at this website is kept in our records only as long as is necessary to provide requested services to our clients.

Modification
We may modify any of the terms and conditions contained in this Agreement, at any time and at our sole discretion, by posting a change notice or a new agreement on our site. Modifications may include, for example, changes to our basic ready-made designs and schemes, our guarantees, e-commerc solutions, changes in the scope of available referral fees, referral fee schedules, payment procedures, and reseller's rules. (currently we do not have a reseller agreement)

IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUED PARTICIPATION IN THE USE OF OUR READY-MADE WEBSITES AND SHOPPING CART SOLUTIONS OR RESELLER'S PROGRAM FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.
